General terms and conditions of business

Art. 1 Scope For online orders of goods from Hotel Adler GmbH, based in Reziastr. 7, 39046 Ortisei/Gröden via the homepage www.adler-resorts.com the following general terms and conditions apply exclusively in the version valid at the time of the order. The buyer can download the text onto his computer or print it out.
Hotel Adler GmbH does not recognize any deviating conditions from the buyer unless Hotel Adler GmbH has expressly agreed to their validity in writing.
Art. 2 Conclusion of contract and right of withdrawal The prices of the goods stated at the time of ordering using the order form on the homepage apply.
A contract between Hotel Adler GmbH and the buyer is concluded through an order from the buyer and acceptance by Hotel Adler GmbH. The buyer's order is placed by submitting the fully completed order form provided on the Hotel Adler GmbH website (www.adler-shop.com). Hotel Adler GmbH accepts the order by sending an order confirmation to the buyer by email.

A claim to delivery only arises once the order has been accepted.

Right of withdrawal in accordance with Legislative Decree No. 206/2005
2.1. The right of withdrawal applies only to the products mentioned in Legislative Decree No. 206 of September 6, 2005.
2.2. The buyer can revoke the concluded contract without penalty and without giving reasons within 14 (fourteen) days from receipt of the ordered goods.
2.3. If the Buyer wishes to exercise his right of withdrawal, he must notify the Seller of this fact using the withdrawal form attached in Annex I, Section B of Legislative Decree No. 21/2014 or any other express and unambiguous statement regarding his decision to revoke the contract. The burden of proof regarding the proper exercise of the right of withdrawal lies with the buyer. In order to exercise the right of withdrawal, the return of the ordered goods, provided that it is carried out within the same period and in accordance with the modalities referred to in article 12, may replace the delivery of the above-mentioned notice. The date of handover to the post office or to the carrier applies.
2.4. The return of the goods must be carried out without delay and in any case no later than 14 (fourteen) days from the moment the Buyer notified the Seller of his decision to withdraw from the contract. A claim to a refund of the full purchase price only exists if the goods are returned intact and in any case in such a condition that can arise from a proper inspection of the nature, properties and functionality of the goods.
2.5. The buyer cannot assert a right of withdrawal when delivering goods that are made according to customer specifications or are clearly tailored to personal needs, which by their nature cannot be returned or which spoil quickly or whose expiry date has been exceeded.
2.6. When exercising the right of withdrawal in accordance with the provisions of this article, the buyer bears the costs directly associated with returning the goods to the seller.
2.7. The buyer who exercises his right of withdrawal as intended will be refunded the amounts already paid, with the exception of the additional costs that arose because the buyer expressly chose a different type of delivery than the cheapest standard delivery offered by the seller. The costs will be reimbursed without delay and in any case within 14 days from the moment the seller was informed of the buyer's decision to exercise the right of withdrawal. However, the seller may refuse repayment until he has received the goods back or until the buyer has provided evidence that he has sent the goods back, whichever is the earlier, unless the seller has offered to do so Collect goods yourself.

2.8. Upon receipt of the notification in which the buyer informs the seller of the exercise of the right of withdrawal, the contracting parties are released from their respective obligations; the provisions of this article remain unaffected.
Express termination clause
2.9 The obligations for the buyer provided for in article 9 are essential to this contract. It is therefore expressly agreed that the failure to fulfill even one of these obligations - unless this is due to coincidence or force majeure - entails the cancellation of the contract in accordance with article 1456 of Italian law. Civil Code without the need for a court judgment.
2.10. Except for the cases expressly mentioned or those established by law, the communications between Seller and Buyer shall preferably be made through email messages to the respective email addresses, considered by both contracting parties as a valid means of communication and the use of which in court is not the only one can be objected to due to the fact that these are electronic documents.
2.11 Written communications to the seller and any complaints are only valid if they are sent to the address Hotel Adler GmbH, Reziastr. 7, 39046 St. Ulrich VAT 0135 0320 212, or by email: adlerspa@adler-dolomiti.com, or T 0039 0471 775 544.
2.12. Both contracting parties may change their email address at any time for the purposes referred to in this article, provided that they immediately notify the other contracting party of this in accordance with the forms referred to in the paragraph above.

Art. 3 Delivery Unless otherwise agreed, delivery will take place from the warehouse to the delivery address specified by the buyer for products that can be delivered immediately within 5-7 working days from receipt of payment. If there are any deviations in the delivery date, we will contact the customer. Unfortunately, it is not possible for us to organize advance telephone notification of delivery.

The risk passes to the buyer as soon as the delivery has been handed over to the transport company by Hotel Adler GmbH or one of its representatives, even if partial deliveries are made.
If no other delivery period has been agreed in writing between the parties, Hotel Adler GmbH undertakes to deliver the goods within 30 days from the day of order confirmation.

Please ensure that someone is available to take delivery of the shipment at the delivery address you provided at the times specified.
Art. 4 Shipping costs Hotel Adler GmbH delivers exclusively within the EU (with the exception of Malta and Cyprus), using transport companies commissioned by them.
Shipping costs for spa products within the EU (except Malta and Cyprus): Euro 10 per order. If you purchase more than Euro 100 of spa products, shipping within the EU (with the exception of Malta and Cyprus) is free.
When delivering wine and oil, the shipping costs listed apply per product.
Deliveries to Malta, Cyprus and outside the EU and notification of the applicable shipping costs are made at the buyer's specific request, whereby Hotel Adler GmbH reserves the incontestable right to reject purchase requests in the case of such deliveries, without giving any special reasons.
Art. 5 Due date and payment The purchase price is due upon order confirmation. The prices apply at the time of ordering.

You can pay with the following credit cards: Visa, Mastercard, American Express
When paying by credit card, the order amount will be debited directly. The charge of your credit card account is carried out with the order is completed.
We would like to point out that when paying with a credit card, your bank may ask for a PIN or password. With the “MasterCard SecureCode” and “Verified by Visa”, your online purchases are protected by requiring you to enter a personal PIN or password during the payment process. If you do not know your PIN or password, please contact your bank.

PayPal is an online payment service that allows you to pay safely, easily and quickly. Your account details are stored in your personal PayPal account and registration takes place exclusively via PayPal. Confirmation of the payment process will be sent to us immediately, which allows your order to be processed quickly. Further information can be found at www.paypal.de.

Art. 6 Warranty and liability The product images do not always have to match the appearance of the delivered products.
Hotel Adler GmbH is liable for defects in the goods delivered by Hotel Adler GmbH in the EU in accordance with the applicable regulations on the purchase of consumer goods (GVD 206/2005).
Hotel Adler GmbH is solely liable for damage that occurred when using the product despite following the instructions for use.

Art. 7 Data protection In accordance with and for the effects of Art. 13 of Legislative Decree No. 196/03 (Italian Data Protection Code), the buyer declares regarding the processing modalities and the purpose of the data processing in question, as well as his rights in accordance with Art. 7 of Legislative Decree No 196/03 and subsequent changes (https://www.adler-dolomiti.com/de/service-kontakt/datenschutz/). By clicking on the box at the end of the general terms and conditions, the buyer expressly confirms that he has received and taken note of the above information and thus gives his consent to the processing of his data by Hotel Adler GmbH with regard to the intended purpose contained therein within the meaning of Article 23 .

Art. 8 Applicable law and place of jurisdiction The exclusive place of jurisdiction is the regional court of Bolzano.
Italian law applies exclusively to the contractual relationships between the contractual partners.
